Out Of State Requests

OUT OF STATE REQUEST FOR SERVICE

The Sheriff's Office will serve all out of state Restraining Orders that were issued by a court for the purpose of protecting a victim of domestic violence, sexual assault, or stalking against another person for free. This includes any civil order of any type or duration so long as it was issued for the purpose of preventing violent or threatening acts or harassment against another person. Other civil process will be served if the appropriate fees are sent with the process (see our fee schedule). We do not accept out of state Fee Waivers.

You must submit written instructions specifying exactly who to serve and at what physical street address. Any additional information such as a description of the person, the work address, type of vehicle and/or color that the defendant drives is helpful but not necessary. These instructions must be dated and signed by the plaintiff or the plaintiff's attorney. If your state requires that the Proof of Service be notarized, you need to state that in your instructions and include an extra $15.00 per person for the notary fee.

The Sheriff's Office does not conduct investigations to locate persons for service of civil process. We cannot take information off of court documents nor can we attempt service at post office boxes.

While we cannot give legal advice, we are happy to answer your questions relating to our duties and areas of responsibility. You can call us at (707) 784-7020.
